Staff Report, Racetrac Developer's Agreement

Analyzing the Developer's Agreement which was submitted by the Racetrac Applicant with the intent to bolster the approval odds of the rezoning application. Staff's recommendation was for the Board to deny this application because the agreement failed to cure the inconsistencies with the Comprehensive Plan, the adverse affect on public interest, and the incompatibility with the surrounding area posed by a potential granting of the rezoning request, and ultimately, the Board agreed with staff and denied both applications.
